April 28th, 1874. Affidavit of death filed showing that said deceased died on or about April 17th.1874 testate and seized or real and personal property.
April 24th.1874. Will filed, admitted to Probate and ordered and Recorded.

In the name of God, Amen, I Patrick Hart of the age of 57 years and of sound mind and memory do hereby make, publish and declare this my last will and testament in the manner following that is to say.
4th:- I, give, bequeath to my son Steven all my interest & claim in the 80 acres of land lying North of John Conlins subject to about one thousand dollars due Mr. Truman.
6th:- I hereby appoint Wm. E. Chandler of the Town of Milan to be my Executor of this my last Will and Testament. In witness whereof I have hereunto set my hand and seal this 14th day of March A. D. 1874.

May 5th. 1874 Refusal of W. E. Chandler to qualify as Executor filed.
June 13th. 1874. Petition of Charles W. Haish for Letters of Administration with Will annexed filed representing that said deceased died on or about April 17th.1874 which will has been duly probated and admitted to record.
That William E. Chandler the Executor named in said will refuses to act and that your petitioner is willing and ready to accept and undertake said trust of Administrator with Will annexed and has been requested by the widow and two adult heirs and also be deceased in his life time in case said Chandler should decline to act as such Administrator. That said deceased died seized of real and personal property.
Widow and heirs are named in will as legatees and devisees. Petitioner prays that your Honor will grant him letters of Administration with Will annexed.
