December 26, 1917, Will filed. In the Probate Court of Cook County proved and admitted to record in open Court this 28th day of January A.D. 1918.
LAST WILL AND TESTAMENT
I, Milton E Holton, of 625 Milburn Street, Evanston, Cook County, Illinois, do hereby make, publish and declare this my last will and testament.
First:- I direct that all my just debts and funeral expenses shall be paid by my Executor.
Second:- I hereby give and bequeath to my adopted son Charles Holton, now residing at #3145 North Paulina Street, Chicago, Illinois, the sum of nineteen hundred and fifty-seven ($1957.00), with interest thereon at five (5%) percent per annum, from November 1, 1916 until paid, and in case of his death the same to go to his legal heirs.
I hereby give and bequeath to each of the following named grandsons and granddaughters as survive me, the sum of One Hundred ($100.00) Dollars, Milton G. Helton, Harold Bates, Loren Bates, Pauline T. Magoon, Sarah Ruth Frantz, and Edith Wells Porteus, all of Minneapolis Minnesota, excepting Edith Wells Porteus, who formerly resided in Evanston, Illinois, and Pauline T. Magoon, who now resides in St. Louis, Missouri, the above requests to be paid within one (1) year from the time of my decease.
Third: – I hereby give, devise and bequeath to the State Bank of Evanston, of Evanston, Illinois, in trust, to be held during the term of the natural life of my personal wife, Sarah M. Holton, all my property, real personal or mixed, wherever the same may be at my decease. It is also my will, and I hereby empower my said trustee to hold, sell, manage and control, to invest, to collect and to reinvest the proceeds of sales and collections as in the judgment of my said trustee may seem best. Also to adjust, compound, or compromise any claim or claims either against or in favor of my said estate; it being my intention that my said trustee shall have full power to deal with any and all of the property as said trustee deems best, the only exception being that the residence where I now live and all household effects and other personal property therein or about the same, shall be under the exclusive control and occupancy of my beloved wife, during her natural life, and it is my desire and request that no appraisement of my household effects be made. It is my will and I direct my said trustee to pay to my wife, Sarah M. Holton, quarterly, from the time of my decease, the net income from all of said property during the term of her natural life, and, at her death, I hereby give, devise, and bequeath what is herein given to said State Bank of Evanston, in trust, to the following named persons and to be divided equally between them. To my son, Joel P. Holton, of Minneapolis, Minnesota, to my daughter Jessie Holton Bates of Minneapolis, Minnesota, to my granddaughter Elizabeth Wells Porteus formerly of Evanston, Illinois, and to my adopted son Charles Holton, of Chicago, and in case of the death of any of the four person above named, the portion so given shall go to his or hers legal heirs.
Fourth:- I hereby nominate and appoint the said State Bank of Evanston, of Evanston, Illinois, Executor of this my last will and testament, and as trustee as herein provided, and I hereby authorize and empower my said executor and trustee to sell at private sale any or all real estate of which I may die sized, wheresoever situate, at such times, for such prices, and upon such terms as to my said executor may seem for the best interest of my estate, and to execute, acknowledge and deliver any and all deeds for said real estate with such terms, provisions and covenants as to my said executor or trustee may seem best. It is my will, however, and I so direct, that my present homestead shall not be sold without the written consent of my said wife.
