WILL

I, Lewis M. Olmstead, of Rockford, Illinois, being of legal age and of sound and disposing mind and memory, do hereby make, publish and declare this to be my last will and testament, herby expressly revoking all wills and codicils to wills heretofore by me made.

First:  I direct that all my just debts and funeral expenses be fully paid and discharged.

Second:  I give and bequeath all of my personal property of every kind and nature, of which I die possessed, whether owned by me now or acquired by me hereafter, to my wife, Maude M. Olmstead.

Third:  I give and devise the following described premises, to-wit:  Lot Eight (8) in Block One (1) in S. M. Church’s Fourth Addition to the City of Rockford, Illinois, otherwise known as 1336 Elm Street, Rockford, Illinois, to my said wife, Maud M. Olmstead.

Fourth:  I give and devise the life use of the following described premises, to-wit:  the Northeast Quarter (1/4) of section Thirty-six (36); the East Half  (1/2) of the Northwest Quarter (1/4) of Said Section Thirty-six (36): the East Half (1/2) of the Southeast Quarter  (1/4) of Section Twenty-five (25); the Southwest Quarter (1/4) of the Southeast Quarter (1/4) of said section Twenty-five; that part of said Section Twenty-five (25) bounded and described as follows, to-wit:  Beginning at the Southeast corner of the Southwest Quarter (1/4) of said section Twenty-five (25) and running thence West on the South line of said Section Twenty-five (25), one hundred (100) rods , thence North eighty (80) rods to the North line of the South half (1/2) of the Southwest Quarter (1/4) of Section Twenty-five (25), thence East on the North line, one hundred (100) rods, to the East line of said Quarter(1/4) Section, thence South on said East line Eighty (80) rods, to the place of beginning, containing fifty (50) acres; and the South two (2) acres of Assessor’s Lot seven (7) on the said Southwest Quarter (1/4) of said Section Twenty-five (25), said two acre tract being immediately North of that part of the said fifty acre tract aforesaid, which is in the West side of the Public Highway, all in Township Thirty-eight (38) North, Range Three(3), East of the Third (3) Principal Meridian, situated in the County of DeKalb and State of Illinois, to my said wife, Maude M. Olmstead.

Fifth:  If my son, Harry H. Olmstead, survives my said wife, then and in that event, I, subject to the said life use of my said wife, give and devise the Northeast Quarter (1/4) of section Thirty-six (36), Township Thirty –eight (38) North, Range

Three (3), East of the Third (3) Principal Meridian, and the Southeast Quarter (1/4) of the Northwest Quarter (1/4) of said Section Thirty-six, in the Township and Range aforesaid, to my said son, Harry H. Olmstead, but if my said son, Harry H. Olmstead, predeceases my said wife, then and in that event, I, subject to the said life use of my said wife, give and devise the Northeast Quarter (1/4) of section Thirty-six (36), Township Thirty –eight (38) North, Range Three (3), East of the Third (3) Principal Meridian, and the Southeast Quarter (1/4) of the Northwest Quarter (1/4) of said Section Thirty-six (36), in the Township and Range aforesaid, to the children of my said son, Harry H. Olmstead, who are living at the time of the death of my said wife, the children of the said Harry H. Olmstead born to him hereafter, included.

Sixth:  If my granddaughter, Joyce Olmstead Seitz, survives my said wife, Maude m. Olmstead, then and in that event, I, subject to the said life use of my said wife, give and devise the East Half (1/2) of the Northeast Quarter (1/4) of the Northwest Quarter (1/4) of Section Thirty-six (36), Township thirty-eight (38) North, Range Three (3), East of the third Principal Meridian, to the said Joyce Olmstead Seitz, but if the said Joyce Olmstead predeceases my said wife, leaving living children who survive my said wife, then and in that event, I, subject to the said life use of my said wife, give and devise the East Half (1/2) of the Northeast Quarter (1/4) of the Northwest Quarter (1/4) of Section Thirty-six (36) aforesaid, to the  children of my said granddaughter, Joyce Olmstead Seitz, who survive my said wife, provided, however, that if , at the time of the death of my said wife, the said Joyce Olmstead Seitz is deceased, and there are no children of the said Joyce Olmstead Seitz then surviving, then and in that event , I, subject to the said life use of my said wife, give and devise the said  East Half (1/2) of the Northeast Quarter  (1/4) of the Northwest Quarter (1/4) of Section Thirty-six (36) aforesaid to the then living children of my said son, Harry H. Olmstead, and to the then living children of any of his then deceased children, the child or children of his then deceased children to take among them their parent’s share.

Seventh: If my grandson, Earl G. Olmstead, survives my said wife, then and in that event, I. subject to the subject to the said life use of my said wife, give and devise the Southeast Quarter (1/4) of the of the Southeast Quarter  (1/4) of Section Twenty-five (25), Township Thirty-eight (38) North, Range Three, East of the Third (3rd) Principal Meridian, to the said Earl G. Olmstead, but if the said Earl G. Olmstead predeceases my said wife, leaving living children, who survive my said wife, then and in that event, I, subject to the said life use of my said wife, give and devise the said Southeast Quarter (1/4) of the of the Southeast Quarter  (1/4) of Section Twenty-five (25), Township Thirty-eight(38) North, Range Three, East  of the Third (3rd) Principal Meridian, share and share alike, to the children of the said Earl G. Olmstead who are living at the time of the death of my said wife, provided, however , that if , at the time of the death of my said wife, the said Earl G. Olmstead is deceased, and there are no children of the said Earl G. Olmstead then living, then and in that event, I, subject to the said life use of my said wife, give and devise the said Southeast Quarter (1/4) of the of the Southeast Quarter  (1/4) of Section Twenty-five (25), Township Thirty-eight(38) North, Range Three, East  of the Third (3rd) Principal Meridian, absolutely and unconditionally, to those of the following named of my grandchildren who are then living to-wit:  Carl Milo Olmstead, Lois Olmstead Goble, Esther Olmstead and Doris Olmstead, share and share alike.

Eighth:  If my grandson, Carl Milo Olmstead, survives my said wife, then and in that event, I. subject to the subject to the said life use of my said wife, give and devise the Northeast Quarter (1/4) of the of the Southeast Quarter  (1/4) of Section Twenty-five (25), Township Thirty-eight (38) North, Range Three, East of the Third (3rd) Principal Meridian, to the said Carl Milo Olmstead, but if my said grandson, Carl Milo Olmstead predeceases my said wife, leaving living children him surviving, who survive my said wife , then and in that event, I, subject to the said life use of my said wife, give and devise the said Northeast Quarter (1/4) of the of the Southeast Quarter  (1/4) of Section Twenty-five (25), Township Thirty-eight(38) North, Range Three, East  of the Third (3rd) Principal Meridian, share and share alike, to the children of my said grandson,  Carl Milo Olmstead who survive my wife, provided, however , that if , at the time of the death of my said wife, the said Carl Milo Olmstead is deceased, and there are no children of the said Carl Milo Olmstead then living, then and in that event, I, subject to the said life use of my said wife, give and devise the said Northeast Quarter (1/4) of the of the Southeast Quarter  (1/4) of Section Twenty-five (25), Township Thirty-eight(38) North, Range Three, East  of the Third (3rd) Principal Meridian, absolutely and unconditionally, to those of the following named of my grandchildren who are then living to-wit:  Earl G. Olmstead, Lois Olmstead Goble, Esther Olmstead and Doris Olmstead, share and share alike.

Ninth:  If my grandson, Ralph Olmstead, survives my said wife, then and in that event, I. subject to the subject to the said life use of my said wife, give and devise the life use of the Southwest Quarter (1/4) of the of the Southeast Quarter  (1/4) of Section Twenty-five (25), Township Thirty-eight (38) North, Range Three, East of the Third (3rd) Principal Meridian, to the said Ralph Olmstead, but if my said grandson, Ralph Olmstead predeceases my said wife, then and in that event, I, subject to the said life use of my said wife, give and devise the said Southwest Quarter (1/4) of the of the Southeast Quarter  (1/4) of Section Twenty-five (25), Township Thirty-eight(38) North, Range Three, East  of the Third (3rd) Principal Meridian, share and share alike, to the children of my said grandson, Ralph Olmstead, born to him in lawful wedlock, who survive my said wife, provided, however , that if , at the time of the death of my said wife, the said Ralph Olmstead is deceased, and there are no children of the said Ralph Olmstead born to him in lawful wedlock then living, then and in that event, I, subject to the said life use of my said wife, give and devise the said Southwest Quarter (1/4) of the of the Southeast Quarter  (1/4) of Section Twenty-five (25), Township Thirty-eight(38) North, Range Three, East  of the Third (3rd) Principal Meridian, absolutely and unconditionally, to those of the following named of my grandchildren who are then living to-wit:  Earl G. Olmstead, Carl Milo Olmstead, Lois Olmstead Goble, Esther Olmstead and Doris Olmstead, share and share alike.

Tenth:  If my granddaughters, Lois Olmstead Goble, Esther Olmstead and Doris Olmstead, survive my said wife then and in that event, I. subject to the life use of my said wife, give and devise the West Half (1/2) of the Northeast Quarter (1/4) of Section Thirty-six (36); that part of Section Twenty-five (25) bounded and described as follows, to-wit: Beginning at the Southeast corner of the Southwest Quarter (1/4) of said section Twenty-five (25) and running thence West on the South line of said Section Twenty-five (25), one hundred (100) rods , thence North eighty (80) rods to the North line of the South half (1/2) of the Southwest Quarter (1/4) of Section Twenty-five (25), thence East on the North line, one hundred (100) rods, to the East line of said Quarter(1/4) Section, thence South on said East line Eighty (80) rods, to the place of beginning, containing fifty (50) acres; and the South two (2) acres of Assessor’s Lot seven (7) on the said Southwest Quarter (1/4) of said Section Twenty-five (25), said two acre tract being immediately North of that part of the said fifty acre tract aforesaid, which is in the West side of the Public Highway, all in Township Thirty-eight (38) North, Range Three(3), East of the Third (3) Principal Meridian, share and share alike, to the said Lois Olmstead Goble, Esther Olmstead, and Doris Olmstead, but should any of my said granddaughters Lois Olmstead Goble, Esther Olmstead, and Doris Olmstead, predeceased my said wife, leaving her or them a child or children surviving, who also survive my said wife , then and in that event, I, subject to the said life use of my said wife, give and devise the West Half (1/2) of the Northeast Quarter (1/4) of Section Thirty-six (36); that part of Section Twenty-five (25) bounded and described as follows, to-wit: Beginning at the Southeast corner of the Southwest Quarter (1/4) of said section Twenty-five (25) and running thence West on the South line of said Section Twenty-five (25), one hundred (100) rods , thence North eighty (80) rods to the North line of the South half (1/2) of the Southwest Quarter (1/4) of Section Twenty-five (25), thence East on the North line, one hundred (100) rods, to the East line of said Quarter(1/4) Section, thence South on said East line Eighty (80) rods, to the place of beginning, containing fifty (50) acres; and the South two (2) acres of Assessor’s Lot seven (7) on the said Southwest Quarter (1/4) of said Section Twenty-five (25), said two acre tract being immediately North of that part of the said fifty acre tract aforesaid, which is in the West side of the Public Highway, all in Township Thirty-eight (38) North, Range three (3), East of the Third 93rd) Principal Meridian, aforesaid, to such of my said granddaughters as are surviving at the at the time of the death of my said wife, and to the child or children surviving at the time of the death of my said wife of such of my said three granddaughters as predecease her, the child or children of the said predeceased granddaughter or granddaughters to take among them their parents share; but if none of my said granddaughters Lois Olmstead Goble , Esther Olmstead, or Doris Olmstead survive my said wife then and in that event, I, subject to the said life use of my said wife, give and devise the said  West Half (1/2) of the Northeast Quarter (1/4) of Section Thirty-six (36); that part of Section Twenty-five (25) bounded and described as follows, to-wit: Beginning at the Southeast corner of the Southwest Quarter (1/4) of said section Twenty-five (25) and running thence West on the South line of said Section Twenty-five (25), one hundred (100) rods , thence North eighty (80) rods to the North line of the South half (1/2) of the Southwest Quarter (1/4) of Section Twenty-five (25), thence East on the North line, one hundred (100) rods, to the East line of said Quarter(1/4) Section, thence South on said East line Eighty (80) rods, to the place of beginning, containing fifty (50) acres; and the South two (2) acres of Assessor’s Lot seven (7) on the said Southwest Quarter (1/4) of said Section Twenty-five (25), said two acre tract being immediately North of that part of the said fifty acre tract aforesaid, which is in the West side of the Public Highway, all in Township Thirty-eight (38) North, Range Three(3), East of the Third (3) Principal Meridian, aforesaid, to the children of the said Lois Olmstead Goble, Esther Olmstead, and Doris Olmstead surviving at the time of the death of my said wife, per stirpes

Eleventh:  The devises and bequests hereinbefore given to my said wife, Maud M. Olmstead, are given to her in full of all statutory or other rights, dower, homestead and widow’s award included, which she has in my property or estate.

Twelfth:  I nominate and appoint my said wife, Maud M. Olmstead, and my son, Harry H. Olmstead, executors of this, my last will and testament, and direct that they be not required to give any bond or security as such executors.
