May 4th, 1858 Will filed, duly probated and admitted to record.
Will
I, Oliver Edmonds of the County of DeKalb and State of Illinois, do make and publish this my last will and testament in manner and form following that is to say:
First: It is my will that all of my funeral expenses and all of my just debts and demands be fully paid.
Second: I give, devise, and bequeath to my wife Elizabeth Edmonds in lieu of her dower the plantation or farm that I now reside upon situated in the County of DeKalb, and State of Illinois and being the South past of Section No. 26 in Township No. 38, Range 3., East of the 3 P.M., and more fully described by reference to said Edmonds deed, supposed to contain about one hundred and ten acres, and also about sixty acres of land a portion of said land is on Section No. 35 and a portion of said land is on Section No. 36 further described by reference to said Edmonds deed, Townsh– and Range as above described, and to have the prophets of said land during her natural life, then to be disposed of as hereinafter mentioned. And also one span of horses and four cows and six shoats, and of the household furniture not otherwise disposed of in this will, and all other items, such as farmin- tolls, and many things that may not be mentioned in this will, and at the death of my wife all the property hereby devised or bequeathed to her as aforesaid or so much thereof as may then remain unexpended, as I shall hereinafter dispose of, or make provision, all of the stock on said farm not dispose_ of to my wife in this Will is to be sold.
Third:- I give to my son Isaac Edmonds the sum of five dollars.
Fourth:- I give to my daughter Mary Roswell the sum of five hundred dollars and to her heirs and assigns forever.
Sixthly:- I give to my son Oliver P. Edmonds the full sum of Twelve Hundred Dollars as soon as my Executors after my decease can raise the money from my estate, his heirs and assigns forever.
Seventhly:- I give to my son John D. Edmonds the sum of five dollars.
Eightly:- I give to my daughter Elizabeth Fairchild the sum of Five Dollars.
Ninthly:- I give and devise to my daughter Margaret M. Edmonds the full sum of One Thousand dollars as soon as the real estate that has been given to my wife is sold.
Tenthly:- I give to my son Edward B. Edmonds the South West Quarter of the South West Quarter of Section No. Three and also the East Half of the South East Quarter of Section No. 4, Township No. 38, Range 3, East P. M., and also about three acres of timber land, lying on the East side of said farm and South of land sold to William Fleming. This piece of land was willed to my wife and I revoke so much of my said will suppose in all to contain about one hundred and twenty three acres of land, his heirs and assigns forever.
Twelfthly:- I give to my grandson Oliver Edmonds the sum of two Hundred dollars, when he arrives to the age of twenty one years.
Thirteenth:- I give to my granddaughter Elizabeth Edmonds the sum of fifty dollars at the age of eighteen years. I do autho— my son Isaac Idmonds, as soon as he can raise the amount given to my son Oliver P. Edmonds to carry the money to him and charge is time and expenses to the Estate.
I hereby constitute and appoint my son Isaac Edmonds and my son in law Lewis Fairchild and John D. Edmonds to be the Executors for this my last will and testament, revoking and annulling all former wills by me made and ratifying and confirming this and no other to be my last will and testament.
I do hereby authorize my executors to sell and convey the titles to all of my real estate, that is not otherwise disposed of in this Will and furthermore to collect all my debts and demands and to pay all of the same, and as soon as the money can be raised to pay off Oliver P. Edmonds, and if any money should be left to put in a fund, and keep it till the whole estate is sold and the whole of the estate then remaining to be equally divided amongst all of the heirs except Catharine Tupper.
I hereby revoke so much of my will as includes Village Lots No. 12 and 13 and Timber Lot 14 to be sold by my Executors and deed the same.
