WILL

In the Name of God, Amen.

            I, Rees Leyson of the Town of Shabbona in the County of DeKalb and State of Illinois of the age of 57 years and being of sound mind and memory do make and publish and declare this my last will and Testament in the manner following:-

            First:-  My will is that after my decease all of my just debts and funeral expenses shall be paid out of my estate by my Executors hereinafter mentioned.

            Second:-  I give and bequeath to my beloved wife Mary Leyson all of my personal property of every description to do with as it seems to her proper.

            Third:-  I give and bequeath to my beloved wife Mary Leyson the West ½ of the North West ¼ of Section 33 and all of the South ½ of the North East ¼ of Section 32 that lies on the South side of the read running from Shabbona Grove to Allen’s Grove also all of the N.E. ¼ of the N.E. ¼ that lies on the South side of said road and also the West ½ of Lot 21 on Section 23 of Township 38 North of Range 3 East of the Third P.M. All of the above described lands are situated in Township 38, County of DeKalb and State of Illinois, to have and to hold during her natural life.

             Fourth:-  I give to my grandson Howel Herbert Franklin Leyson the N1/2of the S.W. ¼ of Section32 and all of the S.E.1/4 of the N.W. ¼ of Section 32 that lies on the South Side of the center if the road running form Shabbona Grove to Allen’s Grove in Township 38, County of DeKalb, state of Illinois, when he shall arrive at the age of 21 years.

            Fifth:-  I give and bequeath to Hannah Leyson widow of Hovel Leyson the use and benefit of the two last described pieces of land until the above Howel Herbert Franklin Leyson arrives at the age of 21 years and if the said Howel Herbert Franklin Leyson should die before arrives at the age of 21 years the said Hannah Leyson shall have the use of the above described land as long as she remains the widow of the said Howell Leyson.

            Sixth:-  I direct and order that as soon as convenient after my decease that all of my real estate not otherwise provided for shall be sold at private or public sale by my Executors hereinafter mentioned and the proceeds of such sale shall be divided as follows;  First $300.00 to be given to my son John L. Leyson and Ten Dollars to my daughter Jane Davis and 1/7 of the remainder to Gweney Evans except $200.00, and 1/7 to Mary Wirick except $150.00 and the rest to be equally divided between Miriam Kenedy, Ann Leyson, Richard Leyson, Elizabeth Leyson and Hannah Leyson the above named Gweney Evans, Mary Wirick, Miriam Kenedy, Ann Leyson, Richard Leyson, Elizabeth Leyson and Hannah Leyson being my son and daughters.

            Seventh:-  I direct and order that as soon as convenient after the decease of my wife Mary Leyson that all of the real estate that I have bequeathed to her during her life shall be sold and divided equally between my last seven named children.

            Eighth:-  I direct and order that in case of the decease of my grandson Howel Herbert Franklin Leyson before he shall arrive at the age of 21 years as soon thereafter as Hannah Leyson shall cease to be the widow of Howell Leyson that the said real estate shall be divided equally between my children that I have bequeathed to the said Howel Herbert Franklin Leyson.

            And Lastly:-  I so nominate and appoint my son John Leyson and my son-in-law Daniel Evans to be the Executors of my Last Will and Testament.  In witness whereof I the said Rees Leyson have to this my last Will and Testament subscribed my name and affixed my seal this fifth day of July, A.A. 1864.
