Will
I, Charles Henry Foiles of the City of De Kalb, in the County of DeKalb and State of Illinois of the age of sixty nine years, being of sound mind and memory do hereby make publish and declare this to be my last will and testament in the manner following that is to say-
First It is my will and desire that all my just debts and funeral expenses be fully paid.
Second I give and bequeath to my wife Minerva M. Foiles all of the household furniture, books, works of art, and other chattels, and effects together with fuel, housekeeping provisions and other consumable stores which shall at my decease be in or about my dwelling house at said City of DeKalb, except money and securities for money, evidence of debt, and of title, and accounts, vouchers, and manuscripts, to be received by her in lieu of an award.
I give and devise to my said wife Minerva M. Foiles the use during her natural life of my homestead in said City of DeKalb and now being the only real estate owned by me situated in said City describe d as follows, to-wit: Lot Thirty two of Section Twenty two in the Township of DeKalb in the County and State aforesaid; Also known and described ad Lot Four in the Block “C” in the Village (now City) of DeKalb, excepting therefrom the North forty feet thereof.
Fourth I give and devise to my son Earl Leroy Foils his heirs and assigns said real-estate above in said third clause described together with all the herditaments and appurtenances thereunto belonging or in any wise appertaining, to have and to hold the said premises to the said Earl Leroy Foiles his heirs and assigns forever. Subject to the life estate therein herein devised to my said wife.
Fifth I give and devise to my said wife Minerva M. Foiles the use during her natural life of the following described real estate situated in said County of DeKalb and State of Illinois to wit – The East Half of the South East Quarter of Section Three and the North East Quarter of the North East of Section Ten all in Township Thirty Seven North Range Three East of the Third P.M. containing One Hundred and Twenty acres, more or less, to be received by her in lieu of dower in any and all my real estate which I may own at the time of my decease.
Sixth I give and bequeath to my daughter Helen E. Baker Five Hundred dollars; To my son Charles B. Foiles One Thousand Dollars; To my son Harris B. Foiles One Thousand Dollars; To my son Fred E. Foiles One Thousand Dollars; and To my son Edward W.; Foiles Seven Hundred Dollars; and in case, after the payments of my debts and funeral expenses and costs of administration of my estate, there should not be sufficient personal property to pay the said legacies in this clause bequeathed, I direct and hereby make such deficiency of said personal property to pay said legacies, a specific charge upon the following described real estate situated in the said County of DeKalb to-wit: The West Half of the South East Quarter of Section Three and the North West Quarter of the North East of Section Ten all in Township Thirty Seven North Range Three East of the Third P.M. containing One Hundred and Twenty acres, more or less, and I hereby direct , authorize and empower my executor hereinafter named, either at public or private sale at his discretion, to sell a portion or all of said real-estate this clause described, to pay the deficiency, if any, of my personal estate to pay said legacies herein in this clause mentioned.
Seventh I hereby give devise and bequeath all the rest, residue and remainder of my estate, real, personal and mixed, of whatsoever kind or nature and wheresoever situated, whether owned by me now or acquired by me hereafter, unto my said daughter Helen E. Baker and my sons Charles H. Foiles, Edward W. Foiles, Harris b. Foiles, Fred E. Foiles and Earl Leroy Foiles, share and share alike.
Eighth I hereby nominate and appoint John H. Larson of the Town of Paw Paw in said County executor of this my last will and testament, hereby revoking all former wills made by me.
