Oct. 15th, 1940. Will filed, and on November 12th, 1940, duly probated and admitted to record.
WILL
I, Nellie ness of the Town of Shabbona, County of DeKalb and State of Illinois, being of sound mind, memory and understanding, do hereby make, publish and declare this to be my last Will and Testament, hereby revoking and rendering void any and all former wills by me made:
First: It is my will that all my just debts and funeral expenses be fully paid.
Second: I give, devise and bequeath unto my beloved sister, Anna Ness, the use, income, and profits of all my property, whether real, personal or mixed, and wheresoever situated, and I hereby authorize and direct my said sister, Anna Ness, in case she deems it for her best interest, to convert any of my property into money, and to make good and sufficient deed conveying the same, the proceeds of the same, however, to be subject to the life use herein designated, but it shall not be necessary for the purchaser of any of said real estate to see to the application of the purchase money.
Third: Subject to the life use herein given to my sister, Anna Ness, I give, devise and bequeath all my property to my sister Louise Steyen, and my brothers John Ness and Henry Ness, in equal shares, and in case of the death of the said Louise Steyen prior to my death, then it is my will that the share so taken by her shall vest in her son Teris Steyen. However in case of the death of said Louise Steyen leaving no children her surviving, then it is my will that the share so taken by her shall be taken by my brothers, John Ness and Henry Ness, subject to the following provisions; that in the case my brother Henry Ness, should die prior to my death, then it is my will that the share so taken by him shall pass to the other legatees and devisees mentioned in this clause, and in case of the death of my brother, John Ness, prior to my decease, then the share so taken by him shall vest in his children share and share alike.
Lastly: I hereby nominate and appoint my sister, Anna Ness, to be Executrix of this my last Will and Testament. However, in case of her death prior to mine or on or about the same time, then it is my will that Conrad M. Munson be Executor.
