LAST WILL AND TESTAMENT

T. Frank Sawyer, of the Village of Waterman, county of DeKalb and state of Illinois, being of sound and disposing mind, memory and understanding, do hereby make, publish and declare this to be my Last will and Testament, hereby revoking any and all other Wills heretofore made by me.

First.  I direct that my executor, hereinafter named, pay all my just debts and funeral expenses as soon after my decease as may conveniently be done.

Second.  All of the household furniture and effects in my place of residence have heretofore been given by me to my wife, Edith Sawyer, and are her property, and she need make no accounting of said property to my executor hereinafter named.

Third.  Subject to the foregoing provisions of my Will, I hereby give, devise and bequeath all the rest, residue and remainder of my estate, both real and personal, or mixed, of which I may die seized or possessed, or to which I may be entitled at the time of my death, and wheresoever the same may be situated, as follows:  One-half thereof to my wife m Edith Sawyer, and one-half thereof to be divided equally between my children, Gailla Lane and Farwell Sawyer, share and share alike, to be theirs absolutely, in fee simple.

In the event my said wife should predecease me, or if her death shall be coincidental with mine, or if we shall perish in common disaster, then, and in either of such events, I give, devise and bequeath the portion herein above devised and bequeathed to my said wife, to my said children, share and share alike, to be theirs absolutely, in fee simple.

In the event that either of my said children pre-deceases me, leaving a child or children him or her surviving, then such child or children shall take his or their parent’s share, per stirpes and not per capita.

Should either of my said children, and his or her children, perish in a common disaster, or their deaths be coincidental, then, and in either of such events, I give devise and bequeath the portion herein above devises and bequeathed to said deceased child to my surviving child, absolutely and in fee simple.

Lastly.  I hereby nominate and appoint my said wife, Edith Sawyer, to be executor of this my Last Will and Testament, and request that she be excused from furnishing any security on her official bond.

In case of the death, incapacity, refusal or failure of my said wife to qualify as such executor, I hereby nominate and appoint my children, Gailla Lane and Farwell Sawyer, executors of this my Last Will and Testament, and direct that they be excused from furnishing any security on her official bond.

IN WITNESS WHEREOF, I have hereunto set my hand and seal and declared this to be my Last will and Testament, this 14th day of January, A. D. 1958
